These Terms of Service (“Terms”) govern your use of the FertOS mobile and web applications (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use FertOS. By using the Service you confirm that you meet this requirement.
FertOS is a fertility companion that helps you plan, track, and organize information across your fertility journey, including cycle tracking, lab-result organization, a personalized plan, partner sharing, and an AI assistant. Features may change over time.
You are responsible for keeping your account secure and for activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
You agree not to: misuse or disrupt the Service; attempt to access other users’ data; reverse engineer or scrape the Service; upload unlawful content; or use the Service in violation of applicable law.
You retain ownership of the data and content you submit (such as lab results and notes). You grant FertOS a limited license to store and process this content solely to operate and improve the Service for you, as described in our Privacy Policy.
The Service relies on third-party providers (e.g. Google, Apple, Stripe, Google Play, Resend, Anthropic, Meta). Your use of those features may be subject to their terms. We are not responsible for third-party services.
FertOS, its design, content, and trademarks are owned by us or our licensors. These Terms do not grant you any right to our intellectual property except to use the Service as permitted.
The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any information is accurate or complete.
To the maximum extent permitted by law, FertOS will not be liable for any indirect, incidental, special, or consequential damages, or for any health outcomes or decisions made based on the Service. Our total liability is limited to the amount you paid us in the 12 months before the claim.
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service and its users.
We may update these Terms. We will post the updated version here and update the “Last updated” date. Continued use after changes means you accept the updated Terms.
FertOS is operated by PROMOTICH LTD (EIK 208023796), Druzhba 2, 1582, 602A, Sofia, Bulgaria. These Terms are governed by the laws of Bulgaria and the European Union, without regard to conflict-of-law rules.
